Texnav

Terms of Use

The rules for using Texnav: our website, our apps for businesses, and the Texnav community. We wrote them in plain English. Please read them, because using Texnav means you agree to them.

1.Who we are and what these terms cover

Texnav ("Texnav", "we", "us") runs Texnav.com. These terms cover everything we run, together called "Texnav":

  • texnav.com and its pages.
  • Our apps for businesses: websites, booking, link pages, reviews, share links, Get found on Google, the Print Center, FAQ, gift cards, memberships and anything we add later.
  • The Texnav community: business pages, the directory, free personal accounts, follows, reviews, updates, messages, "Looking for a pro" requests and For sale posts.
  • Agency accounts that offer Texnav under their own brand.

Texnav is a social community for everyone, people and businesses alike. By using Texnav you agree to these terms, our Privacy Policy and our Community Rules. If you use Texnav for a business, you agree for that business and confirm you're allowed to.

2.Your account

  • Give us true, current information and keep it up to date.
  • You must be 18 or older to use Texnav. That goes for every account: free personal accounts, business accounts, paying us and taking payments. If we learn that someone under 18 has an account, we'll close it and delete their information.
  • Keep your sign-in safe. Sign-in codes and passwords are for you only. You're responsible for what happens in your account, so tell us right away through our contact page if you think someone else got in.
  • One personal account per person. Don't make accounts for other people without their permission.
  • Closing a business account: you can close it any time in Plan and billing. Your pages go offline right away and nothing more is charged. We keep everything for 30 days in case you change your mind, then delete it for good, except the records of what you paid, which we keep for our books.

3.Plans, billing and cancelling

  • Free and paid plans. What each plan includes and costs is on our Pricing page.
  • Billing. Paid plans are charged up front, monthly or yearly, and renew automatically on the card you gave us until you cancel. Prices don't include taxes where taxes apply.
  • Upgrading starts right away. We charge the difference for the rest of your current period.
  • Downgrading or cancelling takes effect at the end of the period you already paid for. You keep what you paid for until then. We don't give refunds or credits for the unused part of a period, except where the law requires it or where we close your account without you breaking these terms (then we refund the unused part).
  • Failed payments. If a payment fails we'll let you know and try again. If it still isn't paid, we may pause paid features until it is.
  • Price changes. We'll tell you at least 30 days before a price change affects your plan. It applies from your next billing period.

4.Taking payments from your customers

Businesses can take payments, deposits, gift cards and memberships from their customers through Stripe. To do that you connect your own Stripe account and agree to Stripe's terms.

  • You are the seller. The sale is between you and your customer. Texnav is not part of it.
  • You're responsible for your prices, your refund and cancellation policies, deposits, disputes and chargebacks, sales tax, and honoring the gift cards and memberships you sell.
  • Stripe's fees, and any Texnav fee shown when you set up payments, are taken from payments as described there.

5.Payments and sales between members

Texnav lets people show each other how to pay them (like Zelle, Venmo, Cash App, PayPal or cash), post their own things for sale, and send quotes and invoices in a chat. When you pay or get paid that way, or buy or sell something you found on Texnav, the deal is only between the two of you.

  • Texnav isn't part of it. We don't hold, send or receive that money, we don't check the people, businesses or things involved, and we can't refund, reverse or get back a payment.
  • Do your own checking before you pay. See the item or the work first when you can, check reviews, and only send money to people you trust. Be careful with anyone who rushes you or asks you to pay before you've seen something.
  • Meet safely. Meet in a public place, in daylight when you can, and bring someone with you for big items.
  • Each payment app has its own terms and protections, and some (like Zelle) offer little or no protection for purchases. Read theirs.
  • You're responsible for what you sell and say: it must be yours to sell, legal, and described honestly. You're also responsible for any taxes on what you sell.
  • If something goes wrong, report the person, post or chat to us. We may remove posts and stop accounts that break these terms or our Community Rules, but we can't settle disputes between members.

6.Emails and texts to your customers

Texnav can send emails and texts for your business, like booking confirmations, reminders and review requests.

  • Only text people who agreed to get texts from you, and stop when they reply STOP. Texnav honors STOP automatically.
  • Only send marketing to people who agreed to it. Booking and receipt messages are fine to send to the customer they're about.
  • You're responsible for what you send and for following the laws on calls, texts and email (like the TCPA and CAN-SPAM in the U.S.).

7.Your content

Your content is yours: your words, photos, logos, services, posts and reviews. You give Texnav permission to store it, show it, resize and format it, and share it as needed to run Texnav. That includes showing your business page in the community and in search, and showing reviews you write. This permission ends when you delete the content or your account, except for copies other people already shared, backups kept for a short time, and what the law makes us keep.

Only upload content you have the right to use. Stock photos from our photo library come with their own license, and you may use them on Texnav. We may remove content that breaks these terms or our Community Rules.

8.The community: business pages, reviews and follows

  • Business pages show what a business has on Texnav: its details, hours, services, photos, updates and reviews.
  • Reviews are written by people with a Texnav account and show right away. Businesses can reply to reviews and report them, but can't remove reviews or choose which ones show on the community. (On their own website, a business can choose which reviews to show.) Texnav decides on reports.
  • Reviews must be honest and about your own experience. Businesses may not pay for reviews, offer anything in return for them, write reviews of themselves or their competitors, or ask anyone to.
  • Following a business means you see its updates and, if you turn them on, get alerts. You can unfollow any time.
  • Everyone in the community follows our Community Rules.

9.What you may not do

  • Break the law, or help anyone else break it.
  • Harass, threaten, bully or hate on anyone, or post sexual or violent content.
  • Pretend to be someone else, or mislead people about who you are or who you work for.
  • Post other people's private information (home address, phone, email, ID or financial details) without their permission.
  • Send spam or unwanted messages, or contact people who asked you not to.
  • Upload viruses or harmful code, try to get into accounts or parts of Texnav you're not allowed in, or overload or disrupt Texnav.
  • Copy, scrape or collect data from Texnav with bots or other automated tools without our written permission. Search engines may index public pages.
  • Resell or rebrand Texnav except through an agency agreement with us.

10.Agencies

Agencies that offer Texnav under their own brand have a separate agency agreement with us. An agency sets its own prices for its members and is responsible for its members' billing and support. These terms still apply to everyone using Texnav through an agency.

11.Our service

  • We work hard to keep Texnav running and your data safe, but we can't promise it will never go down or never have a mistake.
  • We keep improving Texnav, so we may add, change or remove features. If we remove something important you pay for, we'll tell you ahead of time.
  • We may set fair limits, like on storage, sending or page visits, to keep Texnav working well for everyone.
  • We keep backups, but please keep your own copies of anything important too.

12.Other companies' services

Some parts of Texnav work with other companies, like Stripe for payments, Google for reviews and your Business Profile, texting and email providers, and maps. Their own terms apply to their services, and we aren't responsible for them.

14.Ending your account

  • You can cancel your plan any time in Plan and billing. To close your account entirely, send us a message through our contact page.
  • We may pause or close an account that breaks these terms, doesn't pay, or puts other people or Texnav at risk. When we can, we'll tell you first and give you a chance to fix it.
  • Before closing, you can ask us for a copy of your content. After an account is closed, we delete its data within a reasonable time, except what the law requires us to keep.

15.Disclaimers

Texnav is provided "as is" and "as available". As far as the law allows, we don't give warranties of any kind, including that Texnav will be uninterrupted, error-free or fit for a particular purpose. We don't check or promise the quality, safety or legality of any business in the community, their work, or what people say in reviews. Deals between businesses and their customers are between them.

16.Limit of liability

As far as the law allows, Texnav isn't liable for indirect, incidental, special or consequential damages, or for lost profits, data or business, even if we were told they might happen. Our total liability for any claim about Texnav is limited to the greater of what you paid Texnav in the 12 months before the claim, or $100. Some places don't allow some of these limits, so they may not all apply to you.

17.If someone makes a claim because of you

If someone makes a claim against Texnav because of your content, the way you used Texnav, your dealings with your customers, or you breaking these terms or the law, you agree to cover Texnav's reasonable costs from that claim, including lawyers' fees.

18.Disputes and Texas law

If you have a problem with Texnav, please send us a message through our contact page first. Most things can be sorted out quickly. These terms are governed by the laws of the State of Texas and the United States. Any lawsuit about Texnav must be brought in the state or federal courts in Fort Bend County, Texas, and must be started within one year after the claim arose.

19.The rest

  • These terms, the Privacy Policy, the Community Rules, and any agency agreement or plan details you agreed to are the whole agreement between you and Texnav.
  • If one part can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to.
  • You may not transfer your account or these terms without our permission. We may transfer them if Texnav is sold or reorganized.
  • The ZIP code locations we use to find businesses near you come from GeoNames, shared under the Creative Commons Attribution 4.0 license.

20.Changes to these terms

We may update these terms. We'll post the new version here with a new date. For important changes, we'll tell business accounts by email or in their back office at least 30 days before they take effect. Using Texnav after a change means you accept it.
